PartySprinkler is a UK-based online platform that connects parents with party vendors and service providers for children's parties and events. Our service helps you discover, compare, and contact vendors for your party planning needs.

2. Acceptance of Terms

By accessing or using PartySprinkler, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or prominent notice on our website at least 30 days before the changes take effect.

3. User Responsibilities

When using our service, you agree to:

• Provide accurate information: You must provide truthful and accurate information when creating your account and using our services.

4. Content Moderation

PartySprinkler moderates content to maintain a safe and appropriate platform for families. We reserve the right to:

• Review vendor applications: All vendor profiles must be approved by our admin team before appearing on the platform.
• Moderate images: Vendor gallery images require admin approval before being publicly visible.
• Remove inappropriate content: We may remove any content that violates these terms or is inappropriate for a family-friendly platform.
• Suspend or terminate accounts: We may suspend or terminate accounts that violate these terms.

Admin Liability: PartySprinkler administrators make reasonable efforts to review content, but we cannot guarantee the accuracy, safety, or appropriateness of all user-generated content. We are not liable for content posted by users.

5. Vendor Services

PartySprinkler is a platform that connects parents with vendors. We do not directly provide party services.

• No employment relationship: Vendors are independent businesses, not employees of PartySprinkler.
• Direct contracts: Any agreements for services are made directly between parents and vendors.
• Vendor responsibility: Vendors are solely responsible for the quality, safety, and delivery of their services.
• No guarantees: PartySprinkler does not guarantee the quality, availability, or reliability of any vendor services.
• Disputes: Disputes between parents and vendors should be resolved directly between the parties.

5A. Vendor Account Management and Status

All vendor accounts are subject to review, approval, and ongoing moderation by PartySprinkler administrators.

Vendor Application Review

• Admin approval required: All vendor applications must be reviewed and approved by our admin team before appearing on the platform.
• Discretionary decisions: We reserve the right to approve, reject, or restrict vendor accounts at our sole discretion.
• Reasons for rejection/restriction: May include (but are not limited to):
  • Incomplete or inaccurate information
  • Violation of community guidelines or terms of service
  • Safety concerns or inappropriate content
  • Failure to meet quality standards
  • Legal or regulatory requirements
  • GDPR compliance (data processing restrictions under Article 18)

Vendor Account Statuses

• PENDING: Application under review, not visible in vendor search or discovery
• APPROVED: Active vendor profile, visible to parents in search results
• REJECTED: Application denied by administrator, not visible to parents
• RESTRICTED: Account temporarily restricted due to:
  • User data processing restriction request (GDPR Article 18 - Right to Restrict Processing)
  • Administrative action for policy violations
  • Legal or compliance requirements

Effects of Account Restriction

When a vendor account is restricted:

• Hidden from search: Vendor profile is removed from search results and discovery pages
• Read-only access: Vendor maintains access to view historical data but cannot make changes
• No new bookings: Parents cannot initiate new bookings or send new messages
• Existing conversations locked: Past messages remain viewable but no new messages can be sent
• Profile visibility: Vendor profile is not accessible to parents
• Status restoration: When restriction is lifted, the vendor account returns to its previous status (APPROVED or PENDING)

Administrative Rights

PartySprinkler reserves the right to:

• Modify accounts: Change vendor status, profile information, or account settings
• Suspend services: Temporarily suspend vendor accounts for investigation or policy violations
• Terminate accounts: Permanently close vendor accounts that seriously violate our terms
• Remove content: Delete or hide vendor listings, images, or other content that violates our policies
• Enforce restrictions: Implement data processing restrictions to comply with GDPR and other legal requirements
• Modify policies: Update these terms and vendor requirements at any time with appropriate notice

Appeals and Contact

If your vendor application is rejected or your account is restricted:

• Contact us: Email info@partysprinkler.com with your account details
• Provide clarification: Include any additional information that may address the concern
• Request review: Ask for a re-evaluation of the decision
• Response time: We aim to respond to appeals within 5-7 business days

Note: Final decisions on vendor account status remain at the sole discretion of PartySprinkler administrators. We are not obligated to provide detailed reasons for rejection or restriction decisions.

6. Future Monetization

PartySprinkler is currently a free service. We reserve the right to introduce fees in the future with proper notice:

• Currently free: All features are currently free to use during our beta phase.
• Future commission: We may introduce commission fees for vendors when bookings are made through our platform.
• Future subscription: We may introduce subscription or service fees for parents or vendors.
• 30-day notice: We will provide at least 30 days' notice before implementing any fees.
• Right to discontinue: If you do not accept the new fees, you may discontinue using the service.

7. Intellectual Property

All content on PartySprinkler, including text, graphics, logos, and software, is the property of PartySprinkler or its content suppliers and is protected by UK and international copyright laws.

By uploading content to PartySprinkler, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.

8. Limitation of Liability

To the fullest extent permitted by UK law:

• PartySprinkler is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• We are not responsible for vendor services, quality, or safety.
• Our total liability shall not exceed £100 or the amount you paid us in the past 12 months, whichever is greater.

9. Dispute Resolution

These Terms of Service are governed by the laws of England and Wales.

• Governing Law: English law applies to these terms.
• Jurisdiction: Courts of England and Wales have exclusive jurisdiction.
• Informal resolution: We encourage you to contact us at info@partysprinkler.com to resolve disputes informally before pursuing legal action.

10. Termination

You may terminate your account at any time by using the account deletion feature in your dashboard. We may terminate or suspend your account if you violate these terms.

Upon termination, your right to use the service will immediately cease. We may retain certain information as required by law or for legitimate business purposes.
